HOLIDAY DECORATIONS COMPETITION TERMS & CONDITIONS
Social media competition T&Cs
- For the purposes of these Terms and Conditions, “The Promoter” refers to **The District Docklands** whose Instagram, Facebook & TikTok handle is @thedistrictdocklands. The “Prize” refers to a $200 The District Docklands Gift Card.
- By entering the competition, you agree to be bound by these terms and conditions. All entries must be received by 10am on Wednesday 8 January 2025. The Promoter will select one (1) winner in Australia on or after 12pm on Wednesday 8 January 2025 and the winner will be notified by direct message on Instagram, Facebook or TikTok.
- The Promotors competition with entry via Instagram, Facebook or TikTok are open only to residents of Australia. One (1) winner will be chosen from all entrants and across all platforms.
- No purchase necessary. Winners will not be required to pay to enter the competition.
- Entrants must be over 16 years old on the date of their entry.
- Employees of The Promoter are not eligible to enter.
- This promotion is in no way sponsored, endorsed or administered by, or associated with, Meta, TikTok or any other Social Network. You are providing your information to The District Docklands and not to any other party. The information provided will be used in conjunction with the following Privacy Policy found at https://thedistrictdocklands.com.au/privacy-policy/.
- Multiple entries per person per competition will be accepted.
- Each entrant shall enter the competition via Instagram, Facebook or TikTok by (1) Take a photo or video in front of any of our holiday decorations (2) Post on Facebook, Instagram or TikTok. (3) Tag @thedistrictdocklands.
- The Prize will be awarded as a game of skill to the best piece of content entered for the period. The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled.
- The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
- To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
- To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
- Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.
- The name, address, email address and phone number of the winners must be provided to The Promoter if requested and will be shared to enable fulfilment of the Prize.
- In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
- The Promoter’s decision is final. No correspondence will be entered into.
- The winner’s name and social media username may be posted on the social media profiles of The Promotor after the winner has been selected.
- The winner/s agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner/s or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

General
- The promoter of the Competition is the Promoter.
- By entering this Competition, Entrants agree to be bound by these Terms and Conditions. Information on how to enter and prizes form part of these Terms and Conditions.
Eligibility
- Entry is open only to the Entrants, excluding the Exclusions.
- This Competition will be conducted during the Entry Period. Entries must be received by the Promoter during the Entry Period. Entries received after the Entry Period will not count towards the Competition. The Promoter is not responsible for any late, lost or misdirected entries.
Entry
- To enter this Competition, Entrants must complete the Entry, subject to the Limit.
- Route to entry for the competition is via @thedistrictdocklands on Instagram, Facebook or TikTok and details of how to enter and full terms and conditions are via https://www.thedistrictdocklands.com.au/
- Entry to this Competition via Instagram, Facebook or TikTok is free. However, any costs associated with accessing Instagram, Facebook or TikTok are dependent on the internet service provider used.
- Entrants must personally and manually submit an Entry using an internet browser. The Promoter reserves the right to reject an Entry if it reasonably forms the opinion that an Entry has been created and/or submitted using automated entry means or a computer entry service.
- The Promoter reserves the right to verify the validity of an Entry and to disqualify an Entrant for tampering with the entry process or for submitting an Entry that does not, in the Promoter’s sole discretion, comply with these Terms and Conditions.
- All Entries become the property of the Promoter.
Draw
- This Competition is a game of skill.
- The winner(s) of the Prize(s) will be drawn manually at the Draw from all entries received during the Entry Period. The result of the draw is final and the Promoter will not enter into correspondence regarding the result.
Winners
- The Winners will be notified in accordance with the Notification.
- The Winner must claim the Prize within the Claim Period. The Promoter will not be responsible for any delay, loss or damage to the Prize once it has left the Promoter’s or supplier’s premises.
- If the Winner is under 18 years of age, the Prize will be awarded to the parent or legal guardian of the Winner on behalf of the winner.
- If the Winner is unable to comply with these Terms and Conditions and/or does not claim the Prize within the Claim Period, the Promoter reserves the right to conduct an unclaimed prize draw at the Unclaimed Prize Draw to distribute the Prize. The first valid Entry drawn will win the unclaimed Prize.
Prizes
- The prize consists of the Prize, valued at the Total Prize Value.
- The Winner’s use of the Prize is subject to:
the Prize Conditions; and
additional terms and conditions imposed by the supplier(s) of the Prize (if any), with which the Winner must comply.
- The Prize is not transferable and not redeemable for cash or other goods or services. The Prize must be taken as a whole and as stated in these Terms and Conditions. No alternative will be provided, and no compensation will be payable if the Winner is unable to use the Prize as such.
- The value of the Prizes are the recommended retail price as provided by the supplier (inclusive of GST and in local currency) and is correct as at the start of the Competition.
- If the Prize becomes unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the Prize with a prize of equal or greater value and/or specification, subject to regulatory approval.
Your information
- If an Entrant’s contact details changes between the date of entry and the Unclaimed Prize Determination, the Entrant must notify the Promoter of his/her updated contact details.
- The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to conduct the Competition, publicise the name of the Winners and where Entrants have consented to the receipt of such information, send Entrants marketing, advertising and promotional material.
- Entrants’ personal information may be disclosed to third parties who assist the Promoter in conducting this Competition, including regulatory authorities, entities which supply and deliver the Prizes to the Winners, and marketing and communications agencies.
- The Winners’ names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions.
- Entrants can contact the Promoter by mail at 432 – 446 Docklands Drive, Docklands VIC 3008 or by telephone on (03) 9328 8600, to request access to, or corrections of, the Entrant’s personal information held by the Promoter.
Risk and liability
- The Winners participates in this Competition, and uses the Prize, at their own risk.
- The Promoter, its related bodies corporate and the suppliers, agencies and other companies involved in this Competition assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.
- If this Competition is not capable of running as planned for any reason (including as a result of technical failures, fraud or causes beyond the Promoter’s control), the Promoter may, in its sole discretion, cancel, suspend or change the Competition and re-commence it on similar terms, subject to any directions by regulatory authorities.
- To the fullest extent permitted by law, the Promoter, its related bodies corporate and their respective officers, directors, employees and agents exclude liability for all loss (including loss of data, unauthorised access to data and consequential loss), damage, expenses, death or personal injury suffered or incurred arising out of, or in connection with, this Competition (including in relation to the Winner’s participation in this Competition and use of the Prize).
- These Terms and Conditions are subject to the applicable State or Territory trade promotion lottery laws and authorities.
